1. Agreement to Terms

By accessing or using OctaneX ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Platform Description

OctaneX provides:

Grid Trading Bot: Automated grid trading software that you deploy on your own exchange account
Signal Service: Cryptocurrency market analysis and trading signals
Community Platform: Referral program, educational resources, and community features

⚠️ IMPORTANT: Non-Custodial Service

OctaneX is a non-custodial platform. Your funds never leave your exchange account. You connect your own Binance API keys (with trading permissions only, no withdrawal permissions), and all trades execute directly on your account. OctaneX never holds, controls, or has access to your funds.

3. Risk Disclosure

Cryptocurrency trading involves substantial risk of loss and is not suitable for all investors. You can lose some or all of your invested capital. Past performance does not guarantee future results.

3.1 Grid Trading Risks

Grid trading is a market-neutral strategy that profits from price volatility within a defined range. However, it carries specific risks:

Trending markets: Grids underperform in strong directional trends (bull or bear markets)
Impermanent loss: If price moves significantly outside the grid range, you may experience unrealized losses
Exchange fees: Each grid fill incurs trading fees that reduce net profitability
Liquidation risk: While OctaneX uses conservative leverage (1-2x), extreme price moves can still result in liquidation
Technical failures: API disconnections, exchange downtime, or software bugs can affect performance

3.2 Signal Service Risks

Trading signals are provided for informational and educational purposes only:

Signals are not financial advice and do not guarantee profits
Signal accuracy varies based on market conditions
You are solely responsible for your trading decisions
We do not provide personalized investment advice

3.3 General Trading Risks

Cryptocurrency prices are highly volatile and unpredictable
Regulatory changes can impact cryptocurrency markets
Exchange platforms can experience technical issues, hacks, or bankruptcy
You should only trade with funds you can afford to lose completely

4. No Guarantees

We make no guarantees regarding:

Profitability of grid trading or signal following
Accuracy or reliability of signals
Uptime or availability of the Platform
Performance during extreme market conditions

You acknowledge that trading results vary based on market conditions, timing, and individual circumstances.

5. Your Responsibilities

You agree to:

Understand the risks of cryptocurrency trading before using the Platform
Only trade with funds you can afford to lose
Secure your own exchange API keys and account credentials
Never share your API keys with withdrawal permissions enabled
Monitor your positions and understand your exposure
Comply with all applicable laws and regulations in your jurisdiction
Report any bugs or security issues promptly

6. API Key Security

When connecting your exchange account:

Never enable withdrawal permissions on your API keys
Use IP whitelisting when possible
OctaneX encrypts your API keys, but you are responsible for keeping them secure
If you suspect your API keys are compromised, revoke them immediately on your exchange

7. Prohibited Activities

You may not:

Use the Platform for illegal activities
Attempt to hack, exploit, or reverse-engineer the Platform
Share your account credentials with others
Misrepresent your identity or location
Use the Platform from jurisdictions where it is prohibited
Circumvent security measures or rate limits

8. Fees and Payments

Grid licenses, energy refills, and premium features require payment
Payments are processed via NOWPayments (cryptocurrency)
All fees are non-refundable unless required by law
You are responsible for any taxes on your trading profits

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

OctaneX and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid to OctaneX in the 12 months preceding the claim
We are not liable for trading losses, whether caused by market conditions, technical failures, or signal inaccuracies

10. Indemnification

You agree to indemnify and hold harmless OctaneX, its operators, and affiliates from any claims, damages, losses, or expenses arising from:

Your use of the Platform
Your violation of these Terms
Your violation of any third-party rights
Your trading decisions and resulting losses

11. Service Availability

We strive for high availability but do not guarantee uninterrupted service
Maintenance, updates, or technical issues may cause temporary downtime
We may modify, suspend, or discontinue features at any time

12. Intellectual Property

All Platform content, code, and materials are proprietary and protected by copyright. You may not copy, distribute, or create derivative works without permission.

13. Termination

We may suspend or terminate your account for:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the Platform
Non-payment of fees

14. Dispute Resolution

Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable laws.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. Material changes will be announced via the Platform.
